[ARCHIVED] Temporary Surcharge Expiration

Effective August 1, 2023, the temporary surcharge portion of the Judicial Computer Project/Access to Justice/Criminal Justice Enhancement/Office of Attorney General (JCP/ATJ/CJEA/OAG) fee that was authorized in Section 1795.1-E of The Fiscal Code, 72 P.S. § 1795.1-E, expired.  As a result, the temporary surcharge of $21.25 on all cases may no longer be collected.  This means instead of collecting a fee of $40.25, the correct fee would be $19.00 for all cases.

The breakdown of this $19.00 fee that you will collect is as follows:

1.    A fee of $10 is assessed under Sections 3733(a.1)(1) of the Judicial Code, 42 Pa.C.S. §§ 3733(a.1)(1), with $8 allocated to the Judicial Computer System Augmentation Account and $2 to the Access to Justice Account per 42 Pa.C.S. § 3733(a.1)(2)(iii).

 2.    A fee of $2 is assessed under Section 3733.1(a)(3) of the Judicial Code, 42 Pa.C.S. § 3733.1(a)(3), and is deposited into the Access to Justice Account pursuant to 42 Pa.C.S. § 3733.1(a)(3).

 3.    A fee of $2 is assessed under Section 1795.1-E(b)(2) of The Fiscal Code and is deposited into the Access to Justice Account.  72 P.S. § 1795.1-E(b)(2).

 4.    A fee of $2.50 is assessed under Section 1795.1-E(c)(1)(ii) of The Fiscal Code, 72 P.S. § 1795.1-E(c)(1)(ii) and is deposited into the Criminal Justice Enhancement Account pursuant to Section 1795.1-E(c)(3)(ii) of The Fiscal Code, 72 P.S. § 1795.1-E(c)(3)(ii).

 5.    A fee of $2.50 is assessed under Section 1795.1-E(c)(1)(iii), 72 P.S. § 1795.1-E(c)(1)(iii) and is distributed to the Office of Attorney General pursuant to Section 1795.1-E(c)(3)(iii) of The Fiscal Code, 72 P.S. § 1795.1-E(c)(3)(iii).    

Notwithstanding, AOPC hopes this temporary surcharge will be reauthorized as part of the final overall budget package.  We will continue to keep you apprised of developments related to the surcharge and appreciate your understanding in this matter.
